Terms and Conditions for sending me e-mail

Preamble: This text is intended to apply only to Unsolicited Bulk E-Mail (and specifically, but not solely, to Unsolicited Commercial E-Mail). Individuals sending me (Rene Weber) private e-mail generally need not concern themselves with this, but please note that I reserve the right to deem any electronic mail sent to any addresses that I monitor to fit under these terms, whether based on headers, logfiles, or content. If you are concerned about this, please send me e-mail with the subject "[UCE POLICY COMMENTS: To Rene]" and I will consider such a message exempt from the below terms. However, be aware that if you are passing my e-mail address(es) to any other people you must refer them to this page so they can be informed of this agreement before sending me e-mail.

Please note that this text specifically applies to my home e-mail addresses (which match the regular expression "r[a-z0-9_]*@bauhaus.dhs.org"), as well as my work addresses (which match the regular expression "[rmp][eoa][a-z]*@math.u?toronto.[ec][da]u?"). If you are e-mailing any addresses that match these regular expressions, and you do not wish to engage my services, you are hereby advised to ensure that they do not belong to me, as there is a good chance that they do. Of course, this is not an exhaustive list of my addresses, and there are several other addresses that I own or monitor that are also covered under this agreement. For the purposes of this agreement (as well as in general practice), it is the sender's responsibility to verify to whom they are sending their e-mail.

I do not purchase products from companies which send Unsolicited Bulk e-mail (UBE). However, this address functions as a checkpoint for receiving mail -- as a service to entities who send UBE, I may (at my option) report back to them and/or their Internet Service Providers and upstream providers when I recieve their UBE, so that they can be sure that their outgoing mail is working. This service is offered at the cost of $300 Canadian per piece of e-mail that I bounce back, regardless of repeated mailings and source addresses, and commenced on September 1st, 1997. This service began on January 1st, 2000 for the University of Toronto accounts that I monitor, as well as all other e-mail addresses I maintain, own, or monitor. Be warned, any UBE sent after January 1st, 2000 to any addresses that I monitor will be presumed to be for this service -- if you wish to be excluded, you must say so explicitly with specific reference to me and this web page.

In addition, if UBE is sent to this address, the senders, their agents and partners agree to submit to any passive, active, or aggressive site security evaluations which may be performed on machines which were used in the transmission of said e-mail (such as SMTP hosts), as well as connectivity and stress testing of any phone numbers that may have been mentioned and certify that they have the legal authority to grant said rights. This site security testing specifically includes the possibility of "port scanning" as well as testing for known security holes, and if I choose to conduct these site security evaluations you may be billed for them at my discretion and at consultant's fees of $100 an hour, billed hourly.

Also note that I am hereby specifically stating that I am *not* soliciting bulk or commercial e-mail by this notice, but stating my terms should I be sent any without having requested it first. Please note that late payment charges are accrued after thirty days, whether the client (the sender of the UBE) claims to have received my e-mail or not, as long as e-mail was sent out by me to the appropriate recipients (for example the clients' ISPs and their upstream providers). Late payment charges are $100 per month. These terms may be supplemented or changed without notice and are effective on midnight of the day after they were modified. Any e-mail sent to the above mentioned addresses constitutes an agreement to these terms and conditions and an explicit promise to pay.
